§ 3. Electronic services in the Shop
- In the Shop, we provide the following electronic services free of charge: browsing the offer and the basket, the order form, the Account, the contact form and the newsletter.
- To use the Shop, you need a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active email address.
- The contract for the service of browsing the Shop and the basket is concluded for the duration of your use of the website. The contract for maintaining an Account is concluded for an indefinite period when the Account is created. You may log in to your Account using a one-time code sent to your email address. You can delete your Account at any time by writing to us at the email address given in § 1.
- We send the newsletter only to people who have consented to receive it and have confirmed their subscription by clicking the link in the email sent after signing up. You can unsubscribe from the newsletter at any time by clicking the link in any message or by writing to us.
- When using the Shop, you must not provide unlawful content, in particular in forms.
- Using the internet involves typical risks, such as malware or attempts to obtain data by deception (phishing). We never ask for your password or card details by email or by phone.
- You can submit complaints about electronic services to the email address given in § 1. We will reply within 14 days.
§ 4. How to place an order and when the contract is concluded
- Orders can be placed through the Shop 24 hours a day. Orders placed on non-working days are processed on the next working day.
- To place an Order: add Products to the basket, go to the checkout, provide the details needed to fulfil the Order, choose the delivery and payment method, and then click the button confirming the order with an obligation to pay (e.g. “Pay now”).
- Before placing an Order, you will see the total price of the Products, the delivery cost and any other costs, as well as the chosen payment and delivery method.
- Information about Products in the Shop constitutes an invitation to conclude a Contract. Placing an Order constitutes an offer to purchase.
- The Contract is concluded when you receive an email from us confirming acceptance of the Order.
- We send confirmation of the conclusion of the Contract on a Durable Medium to the email address given in the Order, together with the information required by law, including information on the right of withdrawal from the contract and a model withdrawal form, no later than at the time the Product is delivered.
- We make some Products by hand, and natural stones are unique. If, exceptionally, we are unable to fulfil an Order (e.g. the specific piece has been damaged), we will inform you without delay and refund the entire payment received, no later than within 14 days. This does not limit your rights under the law.
§ 5. Prices, promotions and the lowest price in the last 30 days
- Prices in the Shop are given in Polish zloty. They are final (gross) prices, including VAT.
- Prices do not include delivery costs. We show delivery costs when you choose the delivery method, before you place the Order, and on the Delivery page.
- We are bound by the price shown for the Product at the time the Order is placed. Subsequent price changes do not affect Orders already placed.
- Whenever we reduce the price of a Product, we also show, next to the reduced price, the lowest price of that Product in the 30 days before the reduction was introduced. If the Product has been on sale for less than 30 days, we show the lowest price from the day it went on sale until the day the reduction was introduced.
- Discount codes work according to the rules described for the given promotion (including the validity period, the Products covered by the discount and the minimum order value). Codes cannot be combined unless the promotion rules provide otherwise. If a code reduces the price of specific Products or groups of Products, including all Products covered by a promotion announced in the Shop, we show the lowest price in the 30 days before the reduction for those Products: for codes announced in the Shop, throughout the promotion, and for codes provided individually, no later than when they are applied. An order discount code that does not specify particular Products or groups of Products (e.g. a welcome code for newsletter subscribers) reduces the value of the order, not the price of a particular Product.
- We do not personalise prices on the basis of automated decision-making.
§ 6. Payments
- The available payment methods are shown at checkout before you place the Order. They are electronic payments handled by Shopify Payments, in particular payment card, BLIK, Apple Pay and Google Pay (Apple Pay and Google Pay on devices that support them). The service is provided by Shopify International Limited (Ireland), and payments are processed by payment operators working with Shopify (in particular Stripe Payments Europe, Ltd., Ireland).
- You pay when placing the Order. We dispatch the Product once payment has been confirmed.
- We issue an invoice on request. If you are buying for a business, provide the invoice details (including your tax identification number, NIP) when placing the Order.
§ 7. Delivery
- We deliver Products only within Poland. The available delivery methods and their costs are described on the Delivery page and shown at checkout before you place the Order.
- The delivery time is the time needed to prepare the Order for dispatch plus the carrier's delivery time. We prepare Orders for dispatch within 1-3 working days of payment confirmation. If a particular Product requires a longer preparation time, we state that time for the Product before you place the Order.
- When you receive the parcel, it is worth checking whether it is damaged. If it is, you can draw up a damage report with the carrier. For a Consumer and a Sole Trader with Consumer Rights, this is not a condition for exercising the rights described in these Terms.
§ 8. Right of withdrawal from the contract (return within 14 days)
- If you are a Consumer or a Sole Trader with Consumer Rights, you may withdraw from the Contract within 14 days without giving any reason.
- The period runs from the day on which you or a person indicated by you (other than the carrier) took possession of the Product. If a single Order covers several Products delivered separately, the period runs from the day on which the last of them is received.
- To withdraw from the Contract, send us an unequivocal statement, e.g. by email to kontakt@aglie.pl or by letter to ul. Reymonta 2, 62-800 Kalisz. You may use the model form for withdrawal from the contract, but you do not have to.
- To meet the deadline, it is sufficient to send the statement before the period expires.
- If you submit the statement electronically, we will confirm its receipt by email without delay.
- Send the Product back to ul. Reymonta 2, 62-800 Kalisz without delay, and in any event no later than 14 days from the day on which you withdrew from the Contract. It is sufficient to send it before that period expires.
- You bear the direct cost of returning the Product.
- We will refund all payments to you, including the cost of delivery to you, without delay, and in any event no later than 14 days from the day on which we receive your statement. If you chose a delivery method more expensive than the cheapest standard method offered in the Shop, we will not refund the additional cost above that cheapest method.
- We will make the refund using the same payment method that you used, unless you expressly agree to another method that does not involve any costs for you.
- We may withhold the refund until we receive the Product back or until you provide proof that it has been sent back, whichever occurs first.
- You are liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning (as when examining it in a physical shop). Please pack the Product so that it is not damaged in transit.
- Upon withdrawal, the Contract is deemed not to have been concluded.
§ 9. When the right of withdrawal does not apply
The right of withdrawal from the Contract does not apply to a Product that is not prefabricated, is made to your specifications or serves to meet your individual needs, e.g. jewellery made to an individual order, to a design, size or combination of stones specified by you that is outside the standard range. We provide this information for such a Product before you place the Order.
§ 10. Liability for the conformity of the Product with the contract
- We are liable to a Consumer and a Sole Trader with Consumer Rights for the conformity of the Product with the Contract under the rules set out in the Consumer Rights Act, for any lack of conformity that exists at the time of delivery and becomes apparent within two years of that time.
- If there is a lack of conformity of the Product with the Contract, you may demand that it be repaired or replaced. We may replace the Product instead of repairing it, or repair it instead of replacing it, if the method you have chosen is impossible or would involve excessive costs. If both repair and replacement are impossible or would involve excessive costs, we may refuse to bring the Product into conformity with the Contract.
- You may submit a statement of price reduction or of withdrawal from the Contract if: we have refused to repair or replace the Product, we have not repaired or replaced the Product, the lack of conformity persists despite our attempt to remedy it, the lack of conformity is so significant that it justifies an immediate price reduction or withdrawal from the Contract, or it is clear from our statement or from the circumstances that we will not bring the Product into conformity within a reasonable time or without excessive inconvenience to you. You may not withdraw from the Contract if the lack of conformity is minor.
- We bear the costs of repair or replacement, including shipping costs. You also send the Product back at our expense after withdrawing from the Contract because of a lack of conformity. Before sending the Product back, write to us and we will indicate a shipping method at our expense or reimburse you for the shipping cost.
- We refund the amount resulting from a price reduction within 14 days of receiving your statement. After withdrawal from the Contract because of a lack of conformity, we refund the price within 14 days of receiving the Product or proof that it has been sent back.
- Natural stones vary in colour, pattern and size, and handmade jewellery may differ slightly from the piece shown in the photograph. We describe this with the Products. Colours in photographs may also look slightly different because of screen settings. This does not limit your rights if there is a lack of conformity of the Product with the Contract.
§ 11. Complaints
- You can submit a complaint by email to kontakt@aglie.pl or by post to ul. Reymonta 2, 62-800 Kalisz.
- To help us deal with the matter more quickly, please provide: your first name and surname, the Order number, a description of the lack of conformity, the date on which you noticed it and your request. Photographs help us a great deal, but they are not a condition for accepting the complaint.
- We respond to a complaint within 14 days of receiving it, by email or in another way on a Durable Medium. If we do not respond to a Consumer's complaint within that period, we are deemed to have accepted it.
- If we do not uphold the complaint, we will provide you, on a Durable Medium, with a statement as to whether we agree to an out-of-court resolution of the dispute and, if we do, we will also indicate the competent body (see § 13).
§ 12. Customers buying as a business
- A Sole Trader with Consumer Rights, like a Consumer, has the right of withdrawal from the Contract (§ 8 and § 9) and the rights in respect of a lack of conformity of the Product with the Contract (§ 10), as well as protection against unfair contract terms. When making a purchase, you may inform us whether the Contract is of a professional nature for you, but we do not make the conclusion of the Contract conditional on this.
- A Business Customer (within the meaning of § 2) does not have the right of withdrawal from the Contract under § 8.
- In relation to a Business Customer, the Seller's liability under the statutory warranty for defects in the Product (rękojmia) is excluded to the extent permitted by law (Article 558 § 1 of the Civil Code, Kodeks cywilny).
- In relation to a Business Customer, our liability is limited to the price paid for the Product and the delivery costs, and does not include lost profits. This limitation does not apply to damage caused intentionally.
§ 13. Out-of-court dispute resolution
- A Consumer may use out-of-court methods of handling complaints and pursuing claims. Participation in such proceedings is voluntary for both parties. In particular, you can:
- apply to the provincial inspector of the Trade Inspection (Inspekcja Handlowa) for mediation, or to the permanent consumer arbitration court operating at that inspector's office,
- use the free assistance of a municipal or district consumer ombudsman or of a consumer organisation,
- if you live in another European Union country, contact the European Consumer Centre in your country; in Poland, this is the European Consumer Centre Poland: konsument.gov.pl.
- The list of entities authorised to conduct out-of-court consumer dispute resolution proceedings is kept by the President of UOKiK (Office of Competition and Consumer Protection): polubowne.uokik.gov.pl. More information on consumer rights: prawakonsumenta.uokik.gov.pl.
- We decide on participation in out-of-court dispute resolution proceedings on a case-by-case basis and inform you of our decision on a Durable Medium after considering the complaint (see § 11(4)).
- The EU online dispute resolution (ODR) platform ceased operating on 20 July 2025, so we do not provide a link to it.
§ 14. Gift cards
- In the Shop, you can buy a gift card (hereinafter: Gift Card) with a value from 50 to 1000 PLN; the available denominations are shown with the Gift Card in the Shop. The Gift Card is an electronic code that we send by email to the address given in the Order without delay after payment is confirmed. If, when making the purchase, you provide the email address of the recipient, we send the code to that address, either without delay or on the date you specify, and you receive a confirmation email. The price of the Gift Card is equal to its value, and we do not charge for sending it.
- The purchase of a Gift Card is a contract concluded at a distance. § 4(2) to (6) and § 6 apply accordingly to the Order, the conclusion of the contract and payment.
- You can use a Gift Card to pay for an Order of Products from the Shop's entire range, but not for another Gift Card. You can use it for multiple Orders until the balance is used up. If the value of the Order exceeds the balance, you pay the difference using one of the payment methods set out in § 6.
- The Gift Card has no expiry date. You can use the balance without any time limit.
- We do not exchange the Gift Card or its balance for cash or pay it out, either in whole or in part. This does not apply to a refund following withdrawal from the contract for the purchase of a Gift Card (paragraph 7).
- Anyone who knows the Gift Card code can use it to pay, so protect it as you would cash. You may pass the Gift Card on to another person, e.g. as a gift. If you lose the code, write to us (§ 1). Once we have confirmed that the Gift Card was bought by you or for you (e.g. by the Order number), we will resend the code or block the existing code and issue a new one for the unused balance.
- If you are a Consumer or a Sole Trader with Consumer Rights, you may withdraw from the contract for the purchase of a Gift Card without giving any reason within 14 days of the day on which it was concluded (§ 4(5)). You submit the statement as described in § 8(3) to (5). We refund the price of the Gift Card and, if you used part of the balance before withdrawing, we refund the unused amount. We will make the refund without delay, and in any event no later than 14 days from the day on which we receive your statement, using the same payment method that you used for the purchase, unless you expressly agree to another method that does not involve any costs for you. After withdrawal, we block the Gift Card.
- If you paid for an Order in whole or in part with a Gift Card and you withdraw from the Contract (§ 8) or are entitled to a refund of the price because of a lack of conformity of the Product with the Contract (§ 10), we refund the amount paid with the Gift Card to that Gift Card, and the remainder using the payment method that you used. We use a different refund method only if you expressly agree to it and it does not involve any costs for you.
- Complaints concerning a Gift Card (e.g. when the code does not work at checkout) are dealt with in accordance with § 11.
§ 15. Personal data
The controller of Customers' personal data is the Seller. The rules for processing data and information about cookies are described in the Privacy Policy.
§ 16. Final provisions
- Contracts are concluded in Polish and are governed by Polish law. If you are a Consumer from another country, the choice of Polish law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country of your habitual residence.
- These Terms do not exclude or limit the rights of a Consumer or a Sole Trader with Consumer Rights under mandatory provisions of law. In the event of a conflict, those provisions prevail.
- Disputes with a Business Customer are resolved by the court having jurisdiction over the Seller's place of business. Disputes with a Consumer or a Sole Trader with Consumer Rights are resolved by the court having jurisdiction under the general rules.
- We may amend these Terms for important reasons, in particular in the event of changes in the law, in payment or delivery methods, or in the scope of the Shop's services. We announce changes on the Shop's website and, to people with an Account, also by email, at least 14 days before the changes take effect. If you do not accept the changes, you may delete your Account before that date (§ 3(3)). Orders placed before the change are governed by these Terms in their previous wording.
- Matters not governed by these Terms are subject to the provisions of Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną).
- Annex: model form for withdrawal from the contract.
